This Policy applies solely to our operations in the United States and to the personal information of U.S. customers and website users. Contact and Identification Information: When you make a reservation or inquiry, we collect information such as your name, email address, phone number, and mailing address. If you rent a vehicle, we also collect your date of birth (to verify age eligibility) and your driver’s license information (license number, state of issuance, and expiration date). This information is used to identify you, communicate with you about your reservation, and ensure you meet our rental requirements.

Rental Transaction Information: In the course of a vehicle rental, we collect details related to the rental itself. This includes the vehicle type and identification (e.g., vehicle ID or license plate), the rental period (pickup and return dates/times), the location of pickup and return, and any additional products or services you select (such as insurance coverage or accessories). We also record any fees, charges, or fines associated with your rental (rental rate, taxes, young driver surcharge if applicable, toll charges, traffic or parking tickets, damage charges, cleaning fees, etc.). If you contact us for support or to report an issue, we will collect information about the communication and the issue at hand.

Payment Information: When you provide payment for a rental or other services, you will typically enter your payment card details (credit or debit card number, expiration date, CVV code, and billing ZIP code) through our online payment system or in person. We use Stripe to process all payments, so your payment information is transmitted directly to Stripe. We do not store your full credit card number or CVV on our servers. Stripe may retain your card information on file (tokenized) to facilitate transactions and any future refunds or charges (for example, adding late fees or toll charges after the rental). We maintain records of the payment transactions (amount, date, payment method used, and the last four digits of your card for identification) but not the full card details.

Background Check Information (Rideshare Program Applicants): If you apply to rent a vehicle for rideshare or delivery driving purposes (our rideshare rental program), we will collect additional personal information to process your application. This may include your Social Security Number, date of birth, and consent to a background check. We will also collect information about your driving history or any required documents (such as proof of rideshare affiliation or driving record). This information is gathered for the sole purpose of conducting a background and driving record check through our partner Checkr. The sensitive information (like SSN) that you provide for the background check is not stored on our servers beyond the immediate need to transmit it securely to Checkr. Checkr provides us with the results of the background screening (for example, whether you meet our criteria or if any disqualifying history was found). We typically receive a report or an "eligible/ineligible" status. We retain the outcome of the background check and basic identifying details for approved applicants (name, contact information, and the fact that you passed the check), but we do not retain the full background check report or sensitive identifiers on our systems after the check is completed.

Vehicle Telematics and Location Data: Our rental vehicles are equipped with telematics systems (such as Ford Telematics or similar technology) that automatically collect certain data during your rental. This data can include the vehicle’s real-time GPS location, odometer readings, fuel level, engine and maintenance status, and driving information (such as speed, acceleration, and braking events). Advance Van Rental receives access to this telematics data primarily for fleet management purposes: to track and maintain our vehicles, to respond to potential theft or loss, and to assist in emergencies or violations of the rental agreement. For example, if a vehicle is not returned on time, we might use location data to retrieve it. Or if a “check engine” light comes on, we might be alerted to advise you or arrange maintenance. We treat telematics data as personal data when it is linked to a specific customer or rental. We do not use telematics data to monitor where you go except as necessary for the above operational purposes. We do not share individual telematics or location data with unauthorized third parties. (Sharing may occur with law enforcement if required, e.g., to recover a stolen vehicle, as described later in this Policy.)

Website Usage Data and Cookies: When you visit our Site, we and/or our analytics service providers automatically collect technical information about your visit via cookies and similar technologies. This includes your IP address, browser type, device type (e.g., mobile or desktop), operating system, referring URL (the page you came from), pages or content viewed on our Site, and the dates/times of access. We also capture information about your interactions with the Site, such as clicking on links or filling out forms (e.g., starting a reservation form). We use first-party cookies (small data files stored on your browser) to support site functionality—like keeping you logged in during a booking session or remembering your preferences—and for analytics to understand how our Site is used. We do not use third-party advertising cookies that follow you across other sites, nor do we allow external ad networks to directly collect data on our Site for their own purposes. For instance, providing a phone number might be optional for a standard online reservation (but if you provide it, we can call or text you with updates; if not, we’ll rely on email).

2. How We Use Your Information

Providing and Managing Rentals: The primary use of your information is to provide you with the services you have requested – namely, renting a vehicle. This includes using your information to make and confirm your reservation, prepare the rental agreement, verify your identity and age eligibility at pickup, and process payments for the rental and any related charges. We use driver’s license information to ensure you have a valid license and to record who is authorized to drive our vehicles. If you are in the rideshare rental program, we use the application and background check information to determine eligibility and to set up your account.

Communication: We use contact information (email, phone number, mailing address) to communicate with you about your reservations and rentals. For example, we will send reservation confirmations, payment receipts, pickup reminders, and return receipts. We may also contact you during a rental if necessary (e.g., important safety recall information, emergency notifications, or if we detect an issue with the vehicle). If you reach out with questions or support needs, we will use your information to respond to you. We also send notices related to your account or transactions, such as billing statements or policy updates.

Facilitating Payments and Collections: We use payment information to charge for our services via Stripe. If there are additional charges (like tolls, tickets, or damage fees that come in after your initial payment), we may use the payment information on file to process those charges, in accordance with your rental agreement. We also keep records of transactions for accounting, auditing, and billing purposes.

Fleet Management and Safety: Vehicle telematics data and location information are used to manage our fleet and ensure customer safety and compliance. For instance, we may track mileage and engine hours to schedule maintenance. We use location or other data to assist in recovering vehicles that are overdue, lost, or suspected stolen. In the event of an accident or breakdown, we may use location data to send assistance. We also may use incident data (like harsh braking or accident indicators) to respond to potential accidents or misuse of the vehicle in real time.

Legal and Regulatory Compliance: We use and retain personal information as needed to fulfill our legal obligations. For example, we maintain rental records to satisfy government reporting requirements and to handle insurance claims or litigation. If law enforcement or regulatory agencies lawfully request information (for instance, checking rental records related to an investigation), we will use your data to respond as required by law. We also ensure compliance with privacy laws (like responding to consumer rights requests under CCPA) by using your information to verify identity and fulfill requests.

Marketing and Service Improvement: We may use your email or phone number to send you promotional communications about Advance Van Rental’s services, such as special offers, discounts, or updates, if you have consented to or not opted out of such communications. Stripe – Payment Processor: As mentioned, when you make a payment, the details go directly to Stripe. Stripe will use your payment information to process transactions and may store a tokenized version for future charges or refunds. We may also share with Stripe your billing name, address, email, and phone (for receipt delivery or verification). Stripe is obligated to secure your data and not use it for other purposes. Checkr – Background Checks: For the rideshare program applicants, we share the necessary personal data with Checkr, Inc. to perform the background and driving record checks. This includes identification details like your name, address, date of birth, SSN, and driver’s license info, as well as any other information you provided on the application form that Checkr requires. Checkr uses this data to generate a background check report and shares the results with us. Checkr, as a consumer reporting agency, has its own legal obligations to protect your data and use it properly. We do not share your background check report with anyone else – it’s used internally only to decide on your application.

Vehicle Telematics Providers: The telematics and GPS tracking in our vehicles are facilitated by third parties (e.g., the vehicle manufacturer like Ford, or a telematics service provider platform). These providers collect the raw vehicle data and provide it to us through secure dashboards or APIs. Technically, they may have access to the data that passes through their systems. However, they are not permitted to use our telematics data for their own purposes unrelated to providing the service. We have agreements or terms in place that restrict how such data can be used. For example, Ford’s telematics service might aggregate data for their internal analysis, but not in a way that would identify our customers, and they would primarily use it only to support us (e.g., troubleshooting the service).

Communication and IT Service Providers: We use various service providers to operate our website and communicate with you. For instance, our website hosting company will process any data that is transmitted through the site. We might use an email service provider to send out large-scale emails (like a newsletter or reservation confirmations) and an SMS gateway service to send text messages. These providers would have access to your contact info and the content of the messages as needed to perform their functions. We ensure that such providers only use your data under our instructions and not for their own marketing.

We may share information between our corporate entities as needed to operate the business. For example, rental contracts or customer records might be accessible to Duo Fortes LLC for accounting or legal purposes since it owns the assets. All such sharing is internal, and the use of the information is still subject to this Privacy Policy. Our employees and affiliates are only allowed to access personal data on a need-to-know basis.

Legal and Safety Disclosures: We may disclose personal information if required to do so by law or legal process, or if we have a good faith belief that such action is necessary to: (a) comply with the law or with legal proceedings served on us (for example, a subpoena, court order, or government demand); (b) protect and defend our rights or property, or the rights and property of our customers or others (including enforcing our agreements, policies, and Terms of Service, or collecting debts for example); (c) detect, prevent, or otherwise address fraud, security, or technical issues; or (d) respond to an emergency that we believe in good faith requires us to disclose information to prevent serious harm to any person. For instance, if you were involved in an accident and were unconscious, we might share your medical info (if we have any on file) with first responders if it could help. Or if law enforcement is looking for a missing person last seen in one of our vehicles, we might share location data under proper legal request.

Business Transfers: In the event that Advance Van Rental (Cost Less Van Rental, Inc.) is involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be transferred as part of such a transaction. To summarize: we do not sell your personal information, and we do not share it for cross-context behavioral advertising (like selling it to data brokers or giving it to advertisers to target you on unrelated platforms). All sharing is restricted to service providers and necessary business or legal circumstances as described.

5. Data Retention and Security

Data Retention: We keep personal information only as long as necessary for the purposes for which it was collected, or as required by law, whichever is longer. Here are some general guidelines on retention:

Rental Records: We retain records of your rentals (including personal details, rental agreements, invoices, and communications about the rental) for a period of time that satisfies legal and business requirements. This often means a number of years. For example, we might keep basic rental contract information for several years to comply with statutes of limitations (the time period during which legal claims can be made) and regulatory obligations (like tax or insurance regulations). This helps us address any disputes that arise long after a rental (such as an accident claim).

Payment Information: We do not store full card numbers, but we keep transaction records (which include partial card info, amounts, dates) in our billing system for accounting and auditing. Those records are kept according to financial record retention requirements (often 7 years or more, depending on jurisdiction).

Background Check Data: For rideshare program applicants, if you are not approved, we may retain your application info and the result for a certain period (e.g., one or two years) in case you dispute the result or to prevent re-submission under false pretenses. We will not retain the SSN or detailed report beyond what’s needed for that period (typically we’d retain only a note that says you were disqualified due to certain criteria, without the sensitive data). If you are approved and become a customer, we retain your basic account info as long as you remain in the program, and for some time after (similar to other rental records).

Telematics Data: Vehicle telematics data associated with rentals is kept for as long as needed for operational purposes. For instance, location logs might be kept until a vehicle is returned safely, plus a short buffer period, then either deleted or aggregated. Certain events (like an accident or major violation) may be extracted and attached to the rental record and kept as part of that record.

Marketing Data: If you are on our marketing email list, we will keep your contact info on that list until you unsubscribe or it’s clear you are inactive (e.g., emails bounce or you never engage). If you opt out, we may keep your contact info on a suppression list to ensure we honor your opt-out going forward.

Website Logs: Our web server logs and analytics data are generally rotated or deleted periodically (typically within 1-2 years). Some aggregated analytics reports might be kept longer but they don’t personally identify users.

Network and System Security: We maintain technical safeguards like firewalls, intrusion detection systems, and anti-malware solutions to guard our IT infrastructure. We keep our software and systems up to date to protect against vulnerabilities. Our payment processing is handled by Stripe, which is PCI DSS compliant, ensuring card data security.

Monitoring and Testing: We periodically review our security policies and practices. We may conduct security assessments or audits (internally or via third parties) to test the strength of our safeguards.

Data Backups: We secure our data backups as well. Personal information in backups is protected just as the live systems are. In case of any data restoration, the same security measures apply.

Incident Response: We have an incident response plan in case of a security breach. If any personal data is compromised, we will take steps to contain the breach, mitigate harm, and notify affected parties and authorities as required by law.

Despite our efforts, no security measure is 100% foolproof. Cyber risks evolve rapidly, and there is always some risk that an unauthorized third party could find a way to bypass our security. Therefore, we cannot guarantee absolute security of your information. You also play a role in security: for example, if you have a rideshare account, keep your password confidential and do not share it. If you suspect any unauthorized access to your account or data, please contact us immediately.

In the unlikely event of a data breach that poses a significant risk to your rights (such as a breach involving your personal information), we will notify you and any relevant regulatory bodies as required by applicable laws.

6. Your Rights and Choices

You have certain rights and choices regarding your personal information. We strive to honor these rights for all our customers, and we explicitly comply with rights granted by laws like the CCPA/CPRA for California residents. Below is a summary of those rights and how you can exercise them:

Right to Know (Access): You have the right to request that we disclose what personal information we have collected about you. This is sometimes called a "data subject access request." You can request that we provide you with some or all of the following: the categories of personal information we’ve collected; specific pieces of personal information we have about you; the categories of sources from which we collected the information; the business or commercial purposes for collecting it; and the categories of third parties with whom we have shared or disclosed it. For California residents, this right covers at least the 12-month period preceding the request, and you can request such information twice in a 12-month span.

Right to Delete: You have the right to request deletion of personal information we have collected from you and retained, subject to certain exceptions. Upon receiving and verifying a valid deletion request, we will delete (and direct our service providers to delete) your personal information from our records that is not subject to an exception. Note that we may decline or postpone deletion in certain cases – for example, if the information is necessary to complete your transaction (we can’t delete data needed to provide your current rental), to detect security incidents or fraud, to comply with legal obligations (such as maintaining records of transactions for financial reporting, or information needed in the event of a legal claim), or other reasons allowed by law. If we deny a deletion request, we will inform you of the reason.

Right to Correct: If you believe that any personal information we maintain about you is inaccurate or incomplete, you have the right to request that we correct it. Once we verify your identity and validate the request, we will correct the information as you direct (taking into account the nature of the information and the purposes of processing).

Right to Opt-Out of Sale/Sharing: We do not sell personal information as defined under the CCPA (meaning we do not exchange your data with third parties for monetary or other valuable consideration). We also do not share personal information for cross-context behavioral advertising (as defined under CPRA). Therefore, by default, there is no data sale or sharing from which to opt out. If in the future our practices change in a way that constitutes “selling” or “sharing” data under those laws, we will update this Policy and provide a clear opt-out mechanism (such as a "Do Not Sell or Share My Personal Information" link on our website). California residents also can enable Global Privacy Control (GPC) signals on supported browsers; since we currently do not sell/share data, we treat any GPC signal as a formal request to opt-out, which, again, is moot under our current practices but would be honored in spirit.

Right to Limit Use of Sensitive Personal Information: Under CPRA, California residents have the right to limit how a business uses "sensitive personal information" if it’s used for purposes beyond what is necessary to provide goods or services. Sensitive info includes things like social security numbers, driver’s license numbers, precise geolocation, etc. In our case, we collect some sensitive info (driver’s license number, and precise geolocation of vehicles). However, we only use this sensitive information for essential business purposes: e.g., your license number is used to verify your identity and eligibility, and vehicle geolocation is used for safety and fleet management. We do not use sensitive data to infer characteristics about you or for non-essential purposes.
