Welcome to Advance Van Rental. These Terms of Service ("Terms") are issued by Cost Less Van Rental, Inc. dba Advance Van Rental (referred to as "Advance Van Rental," "we," "us," or "our"). These Terms govern your access to and use of the www.advancevanrental.com website (the "Site") and our vehicle rental services (collectively, the "Services") within the United States. By accessing our Site or renting a vehicle from Advance Van Rental, you agree to be bound by these Terms. If you do not agree, you may not use our Site or Services.

Jurisdiction & Eligibility: Advance Van Rental operates exclusively in the United States, with its principal operations in Las Vegas, Nevada. The Site and Services are intended for U.S. residents only. You must be at least 21 years old to rent a vehicle from us. We do not offer rentals to individuals under 21. If you are between 21 and 24 years of age, you may rent from us but will be charged an additional young driver fee of $30 per day. Renters aged 25 or older are not subject to a young driver fee. All renters must hold a valid driver's license and a clean driving record meeting our requirements. By renting, you represent that you meet these eligibility criteria.

1. Account Creation and Rideshare Program

Standard Rentals (No Account Required): For most standard vehicle rentals, you are not required to create an online account on our Site. You may browse vehicle availability and make rental inquiries or reservations without a user account. When you proceed with a rental booking, we will collect the necessary personal information to process your reservation (such as name, contact information, driver's license, and payment details) but will not create a persistent user profile for standard rental customers.

Rideshare Rental Accounts: Advance Van Rental offers a specialized program for rideshare drivers (e.g., those driving for rideshare or delivery services). Participation in the rideshare rental program requires an application and approval process. As part of the application, you will need to provide certain personal information and consent to a background check. We use a third-party service, Checkr, to conduct background checks on rideshare applicants. Your information will be submitted through our Site to Checkr via a secure API solely for the purpose of the background screening. We do not store your sensitive background check data on our servers; we receive only the results needed to determine your eligibility.

If your rideshare rental application is approved, you will be asked to create an account with Advance Van Rental. This account will contain your basic contact information (such as name, email, and phone number) and will allow you to manage your rentals under the rideshare program. You are responsible for maintaining the confidentiality of any login credentials and for all activities under your account. Notify us immediately at privacy@advancevanrental.com of any unauthorized use of your account. Rideshare rental accounts are personal to the approved applicant and may not be shared or transferred.

2. Reservations, Payments, and Fees

Reservations: When you reserve a vehicle through our Site or by other means, you agree to provide accurate and complete information. Reservations are subject to availability and confirmation by Advance Van Rental. We reserve the right to decline or cancel a reservation (e.g., if you do not meet eligibility requirements or if the vehicle is unavailable). We will make reasonable efforts to inform you promptly of any such issue.

Payment Processing: All rental payments (including deposits, rental fees, young driver fees, and any additional charges) must be made with a valid credit or debit card. We use Stripe as our third-party payment processor. By providing your payment information, you authorize Advance Van Rental and Stripe to charge your card for all amounts due for your rental. Stripe may create and store a customer payment profile for you to facilitate payment processing. Importantly, we do not store your credit card numbers or payment account details on our own servers. Stripe handles all payment data in accordance with its security standards and privacy policy. We are not responsible for any errors or security incidents on the part of Stripe, but we will work to resolve any payment issues to the best of our ability.

Young Driver Surcharge: As noted above, rentals by drivers age 21-24 will incur an additional fee of $30 per day. This fee will be disclosed at the time of booking and will be included in the total price of your reservation.

Other Fees: You are responsible for any additional fees that may apply to your rental. These may include, for example, taxes, insurance charges (if you opt for any insurance or protection products), refueling fees, cleaning fees, tolls, traffic or parking violation fines, and charges for loss or damage to the vehicle. We will disclose standard fees (such as taxes or optional insurance) at the time of booking or in the rental agreement. Certain fees, such as fines or damage charges, may be assessed after the rental if incurred. By accepting these Terms, you agree that we may charge your payment method on file for any such amounts incurred during your rental (for example, charging your card for the cost of a traffic ticket you received, or for the cost to refuel if the vehicle is returned with less fuel than provided).

Cancellations and No-Shows: If you need to cancel a reservation, please do so in advance according to the instructions on our Site or your confirmation email. Failure to cancel in a timely manner or no-shows may result in a cancellation fee as described in the reservation terms. Advance Van Rental reserves the right to cancel your reservation if you do not pick up the vehicle at the scheduled time, or if you fail to meet our rental requirements at the time of pickup.

3. Vehicle Pick-Up, Use, and Return

Vehicle Ownership: All vehicles rented through Advance Van Rental are owned by our affiliate, Duo Fortes LLC, and rented out by Cost Less Van Rental, Inc. dba Advance Van Rental. However, for purposes of these Terms and your rental, Advance Van Rental (Cost Less Van Rental, Inc.) is the company providing the vehicle to you under the rental agreement.

Pick-Up Requirements: At the time of vehicle pick-up, you must present a valid government-issued driver's license (appropriate for the class of vehicle being rented) and a matching credit card in your name for payment and security purposes. We may also require proof of insurance or other identification information as permitted by law. If you fail to produce the required documents or meet our standards (for example, if your driver's license is expired, or if you appear under the influence of intoxicating substances), we may refuse to rent the vehicle to you, and any prepaid amount may be subject to forfeiture according to our policies.

Use of the Vehicle: By renting a vehicle from us, you agree to use it safely, responsibly, and in accordance with all applicable laws and our policies. The following rules and restrictions apply to your use of the rental vehicle:

Authorized Drivers: Only you (the renter) and any additional drivers that have been authorized by Advance Van Rental (and who meet our age and license requirements) may operate the vehicle. You must not allow any unauthorized person to drive the vehicle.

Prohibited Uses: You must not use the vehicle for any illegal purpose or in any improper manner. Prohibited uses include but are not limited to: driving under the influence of alcohol or drugs; using the vehicle to commit a crime or in the course of any illegal activity; operating the vehicle in a reckless or abusive manner (such as off-road driving, racing, or stunt driving); using the vehicle to tow or push anything; carrying more passengers or cargo than the vehicle is rated to carry; or allowing smoking or vaping in the vehicle. No smoking is permitted in any Advance Van Rental vehicle – evidence of smoking (e.g., smoke odor, ashes) may result in a cleaning fee.

Geographic Limitations: Our rentals are intended for use within the United States. You may not remove the vehicle from the continental United States without our express permission. Taking the vehicle across international borders (for example, into Mexico or Canada) is strictly prohibited unless explicitly allowed by us in writing.

Vehicle Tracking and Telematics: You acknowledge that our rental vehicles may be equipped with electronic telematics or GPS tracking systems provided by the vehicle manufacturer or Advance Van Rental (for example, Ford Telematics systems). These systems may collect and transmit data about the vehicle’s location, mileage, fuel level, and mechanical diagnostics. We use this data for legitimate purposes such as fleet management, maintenance, anti-theft recovery, and to ensure compliance with these Terms. Personal Property: You are responsible for your personal belongings in the vehicle during the rental. Advance Van Rental is not liable for loss of or damage to personal items left in the vehicle, either during the rental or after return. Please be sure to remove all personal items upon returning the vehicle.

Insurance and Protection: You are required to have automobile liability insurance that meets the minimum requirements of the jurisdiction in which you rent and operate the vehicle. Advance Van Rental provides the minimum liability insurance coverage required by law in the state of rental (for example, Nevada’s state-mandated liability coverage) to authorized drivers of the rental vehicle. This coverage is primary only where required by law; otherwise, any insurance you carry (such as your personal auto insurance or insurance provided by your employer, if applicable) will be primary. We may offer optional insurance products or collision damage waivers at the time of rental for additional protection (subject to the terms of those products). If you decline any optional coverage, you will be responsible for all damage to or loss of the vehicle, as well as any third-party claims arising from your use of the vehicle, to the extent permitted by law. You also remain responsible for any amounts that exceed the coverage limits of any insurance provided.

In the event of an accident or incident during your rental, you must immediately notify both law enforcement (as required by law) and Advance Van Rental. Further instructions for accidents, breakdowns, or claims may be provided in your rental agreement paperwork or by contacting our office. You agree to cooperate with any accident investigation and insurance claim process.

Return of Vehicle: You must return the vehicle on or before the due date and time, and at the location, specified in your rental agreement or reservation. The vehicle should be returned in the same condition as when you received it, except for ordinary wear and tear. This includes returning it with approximately the same level of fuel as provided at pickup. If the vehicle is returned with significantly less fuel, a refueling fee may be charged. Similarly, if the vehicle is returned excessively dirty or with evidence of smoking, you may be charged a cleaning or detailing fee. Failure to return the vehicle at the agreed time and place may result in additional charges and could be reported to authorities as an unauthorized retention or conversion of the vehicle (which may be considered theft under law).

If you need to extend your rental or change the return location or time, you must contact us in advance to request an adjustment. Extensions or changes are subject to approval and may require additional payment. Unauthorized extensions (keeping the car beyond the return time without notice) are not permitted and can result in extra charges and potential legal action.

4. User Responsibilities and Prohibited Conduct (Website and Services)

Accuracy of Information: When using our Site or Services, you agree to provide true, current, and complete information about yourself and your rental needs. You are responsible for any false or misleading information you provide, and for updating information promptly if it changes (for example, if your contact information or driver’s license status changes prior to a rental).

Acceptable Use of the Site: You agree to use the Advance Van Rental website only for its intended purposes (such as viewing vehicle options, making legitimate reservations, or learning about our services). You must not misuse the Site or engage in any activity that interferes with its proper working or with others’ use of the Site. Prohibited activities include: attempting to gain unauthorized access to any portion of the Site or our systems; introducing any virus, malware, or harmful code; performing automated data scraping or data mining of the Site’s content or user information; or using the Site for any fraudulent, unlawful, or abusive purpose. We reserve the right to restrict or terminate your access to the Site if we suspect any improper use or violation of these Terms.

Third-Party Links and Integrations: Our Site may contain links to third-party websites or services (for example, links to our social media pages, or redirecting you to Stripe’s checkout page for payment, or to Checkr’s portal for background check authorization). These links and integrations are provided for your convenience. Please be aware that we do not control and are not responsible for the content, privacy practices, or terms of use of third-party websites or services. If you follow a link to an external site, you do so at your own risk, and any information you provide to those third parties is subject to their policies. Additionally, if our Site integrates third-party services (such as Stripe for payments or Checkr for background checks), your use of those services as part of our process may also be governed by the third parties’ terms and policies (for example, Stripe’s terms of service or Checkr’s disclosure and authorization forms). We are not liable for any acts or omissions of such third parties. However, if you encounter an issue with one of our integrated service providers, we encourage you to notify us so we can attempt to assist or address the matter.

5. Intellectual Property

All content and materials on the Site, including but not limited to our company name and logos, trademarks (including “Advance Van Rental” and related names), text, graphics, images, software, and the design and arrangement of the Site, are the property of Cost Less Van Rental, Inc. dba Advance Van Rental or its licensors. These materials are protected by copyright, trademark, and other intellectual property laws.

Advance Van Rental grants you a limited, revocable license to access and use the Site and its content for the sole purpose of using our Services (for example, to view vehicles and make reservations). You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, or otherwise exploit any content from our Site without our express prior written permission, except as allowed by law (such as brief quotations under fair use). Any unauthorized use of the Site or its content will terminate the permission or license granted by us and may violate applicable law.

If you provide us with any feedback, comments, or suggestions regarding our Services or Site, you acknowledge that we may use and implement such feedback without obligation to you. You agree that any such feedback is provided voluntarily and does not contain confidential or proprietary information of you or any third party.

6. Disclaimers and Limitation of Liability

Service Provided “As Is”: We strive to keep our Site and Services safe, secure, and functioning properly, but Advance Van Rental cannot guarantee continuous, uninterrupted access to the Site or any specific results from the Services. The Site and all vehicles, content, and services provided by Advance Van Rental are offered on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, regarding the Site and the Services. This includes any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We specifically do not guarantee that: (a) the Site or Services will meet your requirements or expectations; (b) the Site will be available on an uninterrupted, timely, secure, or error-free basis; or (c) the results that may be obtained from using the Services (including rental vehicles) will be accurate or reliable.

Vehicle Condition: We are committed to providing well-maintained rental vehicles. However, mechanical failures or unforeseen issues can occur. Except as required under applicable law or expressly provided in a rental agreement, Advance Van Rental makes no warranty or guarantee as to the fitness or suitability of a vehicle for your specific needs. If you encounter any problem with the vehicle, please contact us immediately and we will work with you to address the issue (which may include providing a replacement vehicle or arranging for repairs, as appropriate and available). Advance Van Rental is not responsible for any indirect costs you might incur due to a vehicle issue or breakdown (such as missed travel arrangements or lost income), beyond our obligation to provide a functioning vehicle or appropriate remedy under your rental agreement or the law.

Limitation of Liability: To the maximum extent permitted by law, in no event shall Advance Van Rental (Cost Less Van Rental, Inc.), its parent and affiliated companies (including Duo Fortes LLC), or any of its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to these Terms, the use or inability to use the Site, or the rental of any vehicle, even if we have been advised of the possibility of such damages. This disclaimer includes, without limitation, damages for lost profits or revenues, loss of data, loss of use, rental or replacement costs, or any other commercial or personal damages or losses.

To the extent that we are found liable for any claim arising out of or related to the Site or Services, our aggregate liability to you (for all claims combined) shall not exceed the amount paid by you to Advance Van Rental for the specific rental or service from which the claim arises, or $100 USD if the claim does not relate to a specific rental. Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities, so the above limitation may not apply to you in full. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

Indemnification: You agree that you will defend, indemnify, and hold harmless Advance Van Rental (Cost Less Van Rental, Inc.), its parent company, affiliates, and their respective officers, directors, employees, and agents (the "Indemnified Parties") from and against any and all claims, demands, lawsuits, liabilities, damages, judgments, or expenses (including reasonable attorneys’ fees and costs) that the Indemnified Parties may suffer or incur arising out of or related to: (a) your use or misuse of the Site or Services; (b) your breach of these Terms or any policies or agreements incorporated by reference; (c) your violation of any law or regulation or the rights of any third party in connection with your use of the rental vehicle or the Site; or (d) any accident, injury, or damage sustained by you or caused to others or to property by you in connection with your use of a rental vehicle (except to the extent caused by our gross negligence or willful misconduct). We reserve the right to assume the defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense strategy.

7. Termination and Refusal of Service

Advance Van Rental reserves the right to refuse service, cancel reservations, or terminate your access to the Site or Services at any time, for any reason permitted by law, and without prior notice. For example, we may terminate or suspend your rental or account if we determine that you have violated these Terms, provided false information, failed to pay amounts due, or engaged in conduct that we believe is harmful to our interests or those of other customers or third parties.

If we terminate or cancel a reservation or rental in progress due to your violation of these Terms or unlawful behavior, we may repossess the vehicle immediately. You will not be entitled to a refund of rental fees for unused days in such case, and you may be held responsible for any costs incurred by us as a result of your misconduct (such as towing or recovery fees, repair costs for damage, or cleaning fees).

Termination of your access or rental does not waive or affect any right or remedy that Advance Van Rental may have against you for prior breaches or conduct. The provisions of these Terms that by their nature should survive termination (such as payment obligations, indemnification, liability limitations, and governing law) will continue in effect.

If you wish to terminate your use of our Services, you may simply stop using the Site. If you have created an account (such as a rideshare program account), you may request that we delete or deactivate your account by contacting us (note that we may retain certain information after account closure as described in our Privacy Policy, for legal compliance or legitimate business purposes).

8. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to these Terms, the Site, or the Services shall be governed by and construed in accordance with the laws of the State of Nevada, USA, without giving effect to any conflict of law principles that would result in the application of the laws of another jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

You agree that any legal action or proceeding arising under or relating to these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you hereby consent to the personal jurisdiction and venue of those courts. You further agree to waive any objection on the grounds of inconvenient forum.

Notwithstanding the above, if you are a consumer renting for personal use, and the law of your state of residence mandates a different jurisdiction or certain consumer rights (for example, certain states might allow lawsuits to be filed in your home state), those laws may apply to the extent required. However, in all other cases, the parties intend to designate Nevada law and courts as the default governing law and forum.

No Class Actions: To the extent permitted by law, you and Advance Van Rental each agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis, and not as part of a class, consolidated, or representative action. You further agree that you shall not participate in any class or representative action against us.

9. Changes to Terms

We may update or modify these Terms from time to time. If we make material changes, we will update the "Last Updated" date at the top of this document. In some cases, we may also notify you of changes through additional means (such as by posting a prominent notice on our Site or by email notification, if you have provided your email to us for communications).

It is your responsibility to review these Terms periodically for any updates. If you continue to use the Site or our Services after the effective date of revised Terms, your continued use will constitute acceptance of the revised Terms. If you do not agree to any updated Terms, you should stop using the Site and Services.

10. Privacy Policy

Your use of our Site and Services is also subject to our Privacy Policy (provided below), which outlines how we collect, use, and protect your personal information. We take privacy seriously and comply with applicable U.S. data protection laws (including the California Consumer Privacy Act, as amended by the California Privacy Rights Act). By using our Services or Site, you acknowledge that you have read our Privacy Policy and understand how we handle your information.
